The Blockchain Association (BA) has rejected the National Sheriffs' Association (NSA) criticism of the CLARITY Act, stating that the proposal could expand the tools available to authorities to combat financial crimes involving cryptocurrency.
In a letter sent to Senate leaders John Thune and Chuck Schumer, the entity claimed that the NSA's interpretation of the proposed decentralized finance (DeFi) rules is incorrect.
This discussion comes just days before the Senate's August recess. The Senate is expected to suspend activities on Friday, thereby shortening the timeline for advancing a vote on the Clarity Act.
"I think it’s important to correct any existing misunderstandings about the bill, given that the Senate floor vote is approaching," said BA's policy director Lindsay Fraser.
The NSA had warned that the proposal could create exceptions in anti-money laundering rules, sanctions, and customer identification programs.
The Blockchain Association responded that the proposal sets "strict obligations" for intermediaries and provides authorities with tools to combat financial crime.
Another point of contention is Section 10604, also known as the Blockchain Regulatory Clarity Act. This measure provides protections for non-custodial developers and clarifies that certain software development activities do not automatically make them transmitters of funds.
Fraser stated that the proposal maintains a distinction between "financial intermediaries and neutral software download development."
BA also emphasized that protocols controlled by specific groups cannot evade rules simply by claiming to be decentralized. The proposal also anticipates that the SEC will be involved in developing future rules.
Meanwhile, Senator John Thune has yet to determine the date for the procedural vote. Issues related to the interests of current U.S. President Donald Trump in the cryptocurrency industry are also still under negotiation.
"This letter symbolizes that we have made every effort to address all other outstanding issues so that when we reach an ethical agreement, we are prepared to actively engage and garner as many supportive votes as possible," Fraser stated.
